The adequacy of the penalties in Jordanian Penal Code relating to crimes of Blasphemy from the point of view of judges and lawyers in the governorate of Irbid

Abstract

In this study, the researcher tries to identify the adequacy of the penalties stipulated in the Jordanian Penal Code No.(16) for the year 1960 and its amendments concerning the crimes of blasphemy from the point of view of the judges and lawyers in Irbid governorate. The researcher address the concept of blasphemy and the problematic nature of this concept in its historical context, and then to address the crimes in the Jordanian Penal Code in this regard, which included blasphemy against the prophets, breakfast in Ramadan, Desecration of places of worship, jamming of religious rites, the attack on the burial places of the dead, and insulting religious feeling. The most important results were the inadequacy of these penalties and their disproportionality to those crimes and their seriousness. This requires conducting formal reviews to amend the legal articles, including the intensification of the punishment, to achieve its goal of general deterrence and private deterrence
